Antidumping and Countervailing Duty Litigation
We have proudly and effectively defended foreign exporters and U.S. importers for more than 25 years. Antidumping (AD) and countervailing cases (CVD) are at core of our practice. Our professionals draw upon deep experience, sound judgment, and a pool of nationally-known experts as needed.
AD and CVD cases, which are litigated simultaneously before the U.S. Department of Commerce and the U.S. International Trade Commission, involve complex legal, economic, policy and accounting issues. While technically challenging, these cases generate important and critical barriers to trade as soon as they are filed and must be defended effectively in order to prevent a foreign manufacturer and U.S. importers from being harmed in terms of a sudden and rapid decline in market share. Once imposed, AD and CVD orders are periodically reviewed, but will remain in place indefinitely.
For our clients, success in these cases results in having reduced special duties or potentially zero duties being imposed on specific imports. This allows our clients to ensure that they are not unfairly harmed as a result of the U.S. domestic industry bringing trade remedy actions against them.
Over nearly 25 years our professionals have compiled a solid record of success. A summary of our case experience is available here (link to document). We emphasize close partnerships with our clients and sensible, cost-conscious, result-driven approaches to addressing their needs. We are privileged to work with clients both large and small, including privately-held family-owned businesses and publicly-traded Fortune 500 corporations.
As a separate note, in recent years the cost of unfair trade cases has grown substantially as large law firms have become increasingly expensive. For many businesses and industries, the cost of defending against these trade remedy cases alleging unfairly traded imports has become prohibitive. With this in mind, The Law Offices of Nithya Nagarajan, LLC and its consulting advisors are committed to ensuring that the important benefits of effectively defending trade remedy allegations under the U.S. trade law are accessible to businesses and industries of all sizes.
